Tournament Terms and Conditions

Please read these Terms and Conditions ("Terms") carefully before agreeing to participate in the 2024 Big Challenge Online Fundraising Tournament (“Tournament”) organized by Big Brothers Big Sisters of El Paso (“BBBSEP”, “our”). Your access to and use of the fundraising tournament and its component websites and platforms is conditioned on your acceptance of and compliance with these Terms. By utilizing the Tournament or its component websites and platforms, you agree to be bound by these terms. If you disagree with any part of the terms, you may not utilize the Tournament.


PURPOSE

The purpose of the Tournament is to permit up to 64 qualified Big Brothers Big Sisters agencies (“Participants”) to participate in the 2024 version of The Big Challenge Online Fundraising Tournament. The Tournament is a bracket-driven fundraising challenge with a sports theme, where the Participant raising the most money in a round (“Round”) advances to the next round until one Participant wins the entire Tournament as a result of the completion of the final round. The Tournament is organized by BBBSEP, which will additionally participate as one of the Participants with no special considerations.


QUALIFICATION OF NON-PROFITS & TOURNAMENT RULES

Any U.S.-based Big Brothers Big Sisters affiliate is eligible for consideration and must provide documentation of its 501(c)(3) non-profit status before its participation is approved. In the event more than 64 Participants express interest in the 2024 Tournament, the 64 Participants will be chosen at the sole discretion of BBBSEP. If fewer than 64 Participants participate, the Tournament will begin on the same date and play through as many rounds as needed.

Participants will be seeded bracket-style based on past participation, donations earned, and capacity. All Participants must actively participate in each round. The Participant that advances to the next round of the Tournament will be the one that raises more money than the other Participant participating in their specific bracket via the approved fundraising platform page in the time allotted as described herein:

ROUNDS:

The tournament will run throughout the month of September. Specific Round Dates TBD

For winning the Round, only donations received during the time allotted for your organization’s specific rounds will be counted towards your score. The fundraising landing pages will remain open until 30 Days after the last round, to present the opportunity for Participants to receive additional donations, but those donations will not be counted for Tournament purposes. In the event of a tie, the winner will be the first team who received their final (tying) donation as verified by the timestamp.

By participating in this Tournament, you agree to be bound by the terms of these Rules and by BBBSEP’s decisions, which are final and binding on all matters pertaining to this Tournament.


WEBSITE

For the purposes of the Tournament, BBBSEP owns the website located at donorcharm.org/bigchallenge including all copyrights and trademarks, and further retains all rights to its continued use and development. DonorCharm owns the event platform used on this website.


DONATION PROCESSING, DONOR RECEIPTS & COSTS TO PARTICIPATE

  • All online donations must be received through each individual organization’s Free DonorCharm account with payments processed through the organizations individual Stripe account. Donations will be paid directly through Stripe.com to the individual organization.
  • No upfront cost to participate.
  • The Participant will receive 85% of the net donation, with BBBSEP and DonorCharm retaining 15% as an administrative and creative fee associated with the execution of the Tournament and also to cover any processing fees not covered by donors.
  • DonorCharm’s format will provide donors with a text message and email receipt at the time of their donation. The electronic tax receipt language will include identifying information so the donor has verifiable information on which organization they donated to.


DONOR INFORMATION

  • Each Participant organization will have its own DonorCharm account and maintain exclusive access to its own donor information. This information is confidential and will not be shared or accessible to any other Participant or any external entity, except for DonorCharm. DonorCharm is committed to ensuring the privacy and security of all donor information in accordance with applicable data protection laws.
  • Tournament Host Agency will NEVER claim or contact your donors.
  • All donors receive an automatic tax receipt.

 

 

MEDIA ACTIVITY / PROMOTION

  • By participating in this Tournament, you agree and hereby grant BBBSEP permission to use, copy, modify, distribute, and publicly display Tournament results and data for any purpose, such as, but not limited to, press and media communications, without any compensation or attribution to you. You also agree to participate in any media or promotional activity regarding the Tournament.
  • Customizable flyer templates will be provided.

  •  All participating agencies are responsible for promoting and securing their own donations.

 

HOLD HARMLESSHOLD HARMLESS

The Participant agrees to indemnify, defend, and hold harmless BBBSEP and DonorCharm, its directors, officers, agents, employees, and representatives from all liabilities, losses, claims, judgments, suits, fines, penalties, demands, or expenses that may relate to, result from, or arise out of the Participant’s participation in the Tournament, including but not limited to attorney’s fees and costs, to the fullest extent permitted by applicable law.

 

GOVERNING LAW

  • The validity, construction, and performance of this agreement shall be governed and construed in accordance with the laws of the State of Texas.
  • Each participating agency is responsible for considering local law, individual donor restrictions, etc. that might apply to their participation in a national fundraiser. 

 

BIG BROTHERS BIG SISTERS OF AMERICA AFFILIATE COMPLIANCE

All participation requirements and expectations are in alignment with the BBBSA MAA.

 

Each participating agency must notify BBBSA in writing of their plan to participate along with approval of this fundraising effort within their respective service area.  

*A customizable sample letter will be provided to all participating agencies for this purpose. 

 

 

SIGNATURES

The undersigned have read, understand, and accept this agreement, and further warrant that they are authorized to sign this agreement on behalf of their organization. 

By signing this agreement, all parties agree to all of the aforementioned Terms.
